The given institution is called to protect human rights from encroachments from part of state officials, ensure the development of legislation, elaborate and introduce educational programs. The entire activity of Ombudsman is fulfilled in conformity with the international commitments of Kazakhstan under the ratified Conventions of the UN and with reference to the practice of the similar institutions around the world. Ombudsman also in a close manner cooperates with NGOs, mass media and international organizations. Ombudsman activity’s principles are publicity, objectivity and impartiality.
Kazakhstani Ombudsman conforms to Parisian Principles on the status of national institutions.
In accordance with the legislation, Ombudsman is appointed by the President of the Republic of Kazakhstan after consultations with the Committees of the Kazakhstan Parliament. The term of Ombudsman office is five years which is considered to be as one of the assurances of his/her independence.
All powers and activity methods of Ombudsman are prescribed by the legislation of Kazakhstan, particularly by the Statute on Commissioner for Human Rights established by the Decree # 947 of the President of the Republic of Kazakhstan (September 19, 2002).
The initial years of Kazakhstani Ombudsman’s functioning will be crucial in many aspects, because it is a completely new institution and its efficiency will be estimated by the practical results of its work. The present institution should achieve a public recognition as an effective mechanism of protection of human rights and prove its viability.
